1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") govern your use of the Workforce mobile application and related services (collectively, the "App") operated by BuddyPro AB, Org.nr 559516-1844 ("we," "us," "our," or "Company"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Important: Workforce is designed for employees of organizations that have licensed our BuddyPro SaaS platform. Your use of this App is subject to both these Terms and any employment agreements you have with your employer. Your employer and BuddyPro have separate responsibilities regarding your employment and the App services.
2. DESCRIPTION OF SERVICE
Workforce is an employee task management and time tracking application that provides:
- Task assignment and work order management
- Time tracking and attendance monitoring
- Location tracking for field work and job sites
- Performance and productivity tracking
- Workplace communication and chat functionality
- Payroll integration and wage calculation
- Reporting and analytics for workforce management
- Task pool functionality for self-assignment of work
We provide the technology platform that enables workforce management for your employer. We do not directly employ users or assign work tasks - these functions are managed by your employer through our platform.
3. DATA PROTECTION AND COMPLIANCE
3.1 GDPR and Employment Law Compliance
BuddyPro AB operates in full compliance with the General Data Protection Regulation (GDPR), EU employment laws, and other applicable data protection regulations. All personal data processing is conducted within the European Union on secure servers located within the EU.
3.2 Dual Data Controller Relationship
Both BuddyPro AB and your employer are data controllers for different aspects of your personal data. BuddyPro controls technical and platform data, while your employer controls employment-related data. We maintain appropriate Data Processing Agreements with employers in accordance with Article 28 of the GDPR.

4. ELIGIBILITY AND REGISTRATION
4.1 Eligibility
You must:
- Be at least 16 years old (in compliance with EU data protection standards)
- Be an employee of an organization that has licensed the BuddyPro platform
- Have the legal capacity to enter into these Terms
- Have authorization from your employer to use this App
4.2 Account Creation
Your employer typically creates your account, but you may need to complete registration by providing:
- Valid email address and phone number
- Profile information and preferences
- Emergency contact information
- Banking information for payroll (if applicable)
- Other information required for employment and tax compliance
4.3 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality and security of your account credentials
- All activities that occur under your account
- Providing accurate and up-to-date information
- Notifying us immediately of any unauthorized use or security breaches
- Using the App only for authorized work-related purposes
5. EMPLOYEE OBLIGATIONS AND RESPONSIBILITIES
5.1 Time Tracking and Attendance
As an employee using this App, you agree to:
- Accurately record your work hours, including start times, end times, and breaks
- Clock in and out only when actually beginning and ending work activities
- Report any time tracking errors or technical issues promptly
- Comply with your employer's attendance and punctuality policies
- Not engage in time theft or fraudulent time reporting
5.2 Task Management and Performance
You agree to:
- Complete assigned tasks diligently and according to instructions
- Accept or reject tasks from the task pool promptly when enabled
- Provide accurate updates on task progress and completion
- Communicate work-related issues and challenges appropriately
- Maintain professional standards in all work activities
5.3 Location and Field Work
For field work and location-based tasks, you agree to:
- Allow location tracking during work hours as required for job functions
- Work at assigned locations and job sites as instructed
- Report location-related issues or concerns to supervisors
- Comply with safety protocols at all work locations
5.4 Communication and Conduct
You agree to:
- Use workplace chat and communication features professionally
- Treat supervisors, managers, and colleagues with respect
- Follow your employer's code of conduct and workplace policies
- Report workplace safety issues or concerns appropriately
- Maintain confidentiality of proprietary and sensitive information
6. TASK ASSIGNMENT AND WORK MANAGEMENT
6.1 Task Assignment Process
- Tasks are assigned by your employer through managers, supervisors, or automated systems
- Task assignments are binding work instructions from your employer
- You must complete assigned tasks within specified timeframes
- Task modifications or disputes should be addressed with your supervisor
6.2 Task Pool Functionality
- When enabled, you may accept or reject available tasks from the task pool
- Task pool participation is subject to your employer's policies and availability requirements
- Accepted tasks become binding work assignments
- Your employer may restrict or modify task pool access at any time
6.3 Performance Monitoring
- The App tracks various performance metrics including task completion times and productivity
- Performance data may be used by your employer for evaluations, scheduling, and management decisions
- You have the right to access your own performance data
- Performance monitoring complies with applicable employment laws and data protection regulations
7. PAYROLL AND COMPENSATION
7.1 Wage Calculation
- The App facilitates calculation of wages based on recorded work hours and completed tasks
- Final compensation decisions remain with your employer
- You are responsible for reviewing and reporting any payroll discrepancies
- Payroll processing complies with applicable tax and employment laws
7.2 Tax and Legal Compliance
- The App processes necessary tax information and withholdings as required by law
- You are responsible for providing accurate tax information and documentation
- Payroll records are maintained for legal compliance and audit purposes
- Direct deposit and payment processing are subject to banking and financial regulations
8. PLATFORM RULES AND CONDUCT
8.1 Prohibited Activities
You may not:
- Use the App for any illegal, unauthorized, or non-work-related purpose
- Falsify time records, location data, or task completion information
- Share your account credentials or allow others to use your account
- Interfere with or disrupt the App's operation or security
- Attempt to circumvent time tracking, location monitoring, or other App features
- Harass, abuse, or inappropriately communicate with other users
- Violate your employer's policies or workplace rules
- Access or attempt to access other employees' personal information
8.2 Data Accuracy and Integrity
You must:
- Provide accurate and truthful information in all App interactions
- Report technical issues or data discrepancies promptly
- Comply with all data protection and privacy requirements
- Use the App's communication features professionally and appropriately
8.3 Security and Confidentiality
You agree to:
- Maintain the security of your device and account
- Not share sensitive work information through unsecured channels
- Follow all cybersecurity policies and best practices
- Report security incidents or suspicious activities immediately
9. DATA AND PRIVACY
9.1 Employment Data Sharing
By using the App, you acknowledge and agree that:
- Your work-related data will be shared with your employer, including time tracking, task completion, location data, and performance metrics
- Your employer has legitimate business needs to access this information for workforce management
- This data sharing is necessary for employment functions and legal compliance
- Both BuddyPro and your employer have obligations to protect your personal data under GDPR
9.2 Location Services and Tracking
The App uses location data to:
- Verify your presence at assigned work locations and job sites
- Track travel time and field work activities
- Ensure compliance with work assignments and safety protocols
- Calculate location-based pay differentials when applicable
9.3 Data Protection Rights
You have comprehensive rights under GDPR regarding your personal data, though some rights may be limited in the employment context due to legal requirements and legitimate business needs. 10. INTELLECTUAL PROPERTY
10.1 Platform Ownership
The App, including all content, features, and functionality, is owned by BuddyPro AB and protected by intellectual property laws.
10.2 Work-Related Content
Content created during work activities, including task reports, communications, and work-related data, may be subject to your employer's intellectual property policies and applicable employment law.
10.3 License to Use
We grant you a limited, non-exclusive, non-transferable license to use the App for authorized work-related purposes during your employment.
11. DISCLAIMERS AND LIMITATION OF LIABILITY
11.1 Platform Disclaimers
- The App is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free operation
- Technical issues may occasionally affect time tracking, location services, or other features
- You are responsible for reporting technical problems that affect your work or compensation
11.2 Employment Relationship
- BuddyPro is not your employer and does not control your employment relationship
- Employment decisions, including hiring, firing, and compensation, are made by your employer
- Workplace disputes should be addressed with your employer according to their policies
11.3 Limitation of Liability
To the maximum extent permitted by law, our liability for any claims related to your use of the App is limited. This limitation does not affect statutory rights that cannot be excluded under applicable employment law.
12. EMPLOYER RESPONSIBILITIES
12.1 Employer Obligations
Your employer is responsible for:
- Complying with employment laws and regulations
- Ensuring fair and legal use of employee data collected through the App
- Providing appropriate training on App usage and workplace policies
- Addressing employment-related disputes and concerns
- Maintaining their own privacy policies for employment data
12.2 Data Controller Responsibilities
As a data controller for employment data, your employer must:
- Have lawful basis for processing employee personal data
- Respect employee data protection rights under GDPR
- Implement appropriate data security measures
- Respond to employee data requests appropriately
13. TERMINATION
13.1 Termination by Employment Status
Your access to the App may be terminated when:
- Your employment with the licensed organization ends
- Your employer cancels their BuddyPro platform license
- You violate these Terms or your employer's policies
- Legal or regulatory requirements necessitate termination
13.2 Immediate Termination
We may immediately terminate your access if you:
- Engage in fraudulent time reporting or other dishonest activities
- Pose a security risk to the platform or other users
- Violate data protection laws or privacy requirements
- Use the App for illegal activities
13.3 Effect of Termination
Upon termination:
- Your access to the App will cease immediately
- Employment-related data will be retained according to legal requirements
- Final payroll processing will be completed according to applicable law
- Certain provisions of these Terms survive termination
14. DISPUTE RESOLUTION
14.1 Employment vs. Platform Disputes
Different dispute resolution processes apply depending on the nature of your concern:
- Employment-related disputes: Should be addressed through your employer's HR processes and applicable employment law
- Platform and data protection disputes: Should be addressed with BuddyPro through the processes outlined below
14.2 Governing Law
These Terms are governed by the laws of Sweden and applicable EU regulations, including GDPR and employment directives.
14.3 BuddyPro Platform Dispute Process
For disputes related to the App platform, data protection, or these Terms:

- Engage in good faith negotiation and mediation if direct resolution fails
- Submit to binding arbitration under Swedish law if other methods are unsuccessful
For Data Protection Complaints: You have the right to lodge complaints with supervisory authorities under GDPR, including the Swedish Authority for Privacy Protection (IMY) at www.imy.se
15. GENERAL PROVISIONS
15.1 Modifications
We may modify these Terms to reflect changes in law, regulations, or platform functionality. Material changes will be communicated through the App or email. Continued use after modifications constitutes acceptance, though certain changes may require explicit consent.
15.2 Compliance with Employment Law
These Terms are subject to applicable employment laws and regulations. Where employment law provides greater protections or rights, those laws take precedence over conflicting provisions in these Terms.
15.3 Language and Interpretation
These Terms are provided in English. In case of any conflicts between different language versions, the English version shall prevail.
15.4 Severability
If any provision of these Terms is found unenforceable, the remainder shall remain in full force and effect.
15.5 Entire Agreement
These Terms constitute the entire agreement between you and BuddyPro AB regarding the App, but do not supersede your employment agreement with your employer.
